Terms And Conditions

Guidelines and Policies for the Use of Tonkra Messenger: Terms and Conditions to Ensure a Secure and Positive User Experience.

DEFINITIONS

  • App, Application or System – This refers to TONKRA’s application that enables the sending of messages via multiple channels.
  • Network Operator – Means any party licensed to install, operate, and maintain a cellular telephony network.
  • Services – Shall mean and include all products and services offered or provided to Users by BulkSMS, Email, etc.
  • User – Shall mean any natural or legal person who makes use of any of the services or who uses or visits the application.
  • Privacy – Means the protection of information that identifies and/or concerns an individual or a group.
  • Sender ID – A unique alphanumeric or numeric identifier set by the User to represent the sender of an SMS message.

SERVICES

TONKRA shall:

  1. Endeavor to make available uninterrupted use of its system and delivery of all messages sent using its application.
  2. Not guarantee the availability of any Service, the delivery of SMS messages, or the compatibility between any message or content format and any mobile handsets or mobile operating systems.
  3. Modify, enhance, develop, or discontinue components of its services if Network Operators make changes, without prior notice to users.
  4. Inform users of any updates, upgrades, or downtimes to be experienced on its application, reasonably practicable.
  5. Deem messages delivered when transmitted to the appropriate network and feedback status received.
  6. Have the right to withhold, terminate, or suspend services to a User at any time for actions affecting TONKRA’s brand or services.
  7. Allow Users to set a unique Sender ID to represent themselves in SMS messages.

Users are cautioned against:

  • Sending spam on the platform.
  • Using the system for fraudulent messages.
  • Using the application for phishing.

TONKRA may withhold, terminate, or suspend services if users engage in prohibited activities, and users shall not be refunded any cash for unused credit. Users indemnify TONKRA against fines or damages resulting from user actions that breach laws or codes of conduct.

CONTACTS

  1. Users are responsible for the contacts they send SMS messages to using TONKRA’s platform.
  2. Users must comply with applicable laws and regulations regarding the sending of SMS messages to contacts.
  3. TONKRA shall not be held liable for any misuse of contacts by users.
  4. Users shall indemnify TONKRA against any fines or damages arising from the misuse of contacts.

SECURITY

To use the platform, a User must:

  1. Complete the registration process with accurate information.
  2. Choose a Username/Email and password.
  3. Maintain the confidentiality of Username/Email and passwords.
  4. Notify TONKRA immediately of any unauthorized use or security breach.

Users are entirely responsible for account activities and liable for charges incurred. If a User wishes to replace account details, TONKRA must be informed in writing with sufficient proof of identity. TONKRA may refuse to act without proper proof, with no liability for claims related to privacy, security, or confidentiality.
